Photo Consent at Ka Makana Ali‘i

By entering this area, you acknowledge that you may be photographed, filmed, or recorded for security, safety, and operational purposes. Your entry constitutes acceptance of the following terms:

  • Surveillance: This premises may be under video and audio surveillance at any time. Audio recording is limited to areas where there's no reasonable expectation of privacy.
  • Consent: Your presence in this area signifies your awareness and explicit consent that recording may occur by various means, including but not limited to video cameras, still cameras, and audio recording devices.
  • Usage: Any recordings or images obtained may be used for security purposes, incident investigations, quality control, marketing, promotional activities, and as evidence in legal proceedings if necessary. By entering this property, you acknowledge and agree that such content may be used for commercial and promotional purposes without compensation or further consent. For minors, parental/guardian consent is assumed for such usage.
  • Marketing Consent: Your presence on these premises constitutes your agreement to appear in marketing and promotional materials without payment or additional permissions. While you waive the right to review or approve the finished products, you may contact our office to request removal of your image from future use.
  • Responsibility: It is your responsibility to read, understand, and comply with all terms of this notice. If you do not agree to these terms, please do not enter the premises. These terms may be updated periodically; current terms are always available at our Center Office.
  • Data Retention and Protection: If recordings are made, they will be retained and protected in accordance with applicable laws and our data retention policy. Personal data will be handled as per our Privacy Policy.
  • Privacy: We respect your privacy rights as outlined in our Privacy Policy, available upon request. You may opt-out of marketing use of your image by contacting our office.
  • No Expectation of Privacy: While on these premises, you acknowledge that you have no reasonable expectation of privacy in public areas.
  • Ownership: Any recordings made remain the sole property of Ka Makana Aliʻi.
  • No Guarantee of Surveillance: Ka Makana Aliʻi does not guarantee continuous surveillance or recording. The presence or absence of surveillance equipment does not imply any additional duty of care.
  • Limitation of Liability: Ka Makana Aliʻi is not liable for any loss, damage, or injury that may occur due to the presence, absence, or malfunction of any surveillance equipment.
  • Inquiries and Opt-Out: For questions regarding this policy, to request removal of your image from marketing materials, or to opt-out of marketing use, please contact the Center Office at 808-628-4800.
  • Governing Law: This agreement is governed by the laws of the State of Hawaii.
  • Severability: If any part of this notice is found to be unenforceable, the remaining provisions will continue to be valid and enforceable.

This notice is in compliance with Hawaii Revised Statutes, including but not limited to HRS § 711-1110.9, and other applicable laws. Full copies of this policy are available upon request at the Center Office.
